Drug Possession
Peter Geoffrey Barwick 51, from Guy Street, Wauchope pleaded guilty to the charge of possessing a prohibited drug.
Police facts said at about 3.05pm on January 10 police conducted a police search of Barwick on Cameron Street. The search resulted in the discovery of marijuana in his pocket. The cannabis had weighed 3.68 grams.
Barwick was fined $400 and the drug was ordered to be destroyed.
Excessive speed
David William Ciardi 50, from Forest Grove, Port Macquarie did not appear on a charge of exceeding the speed limit of over 20 kilometres an hour.
Facts said at 9.50pm on September 30, 2016 Ciardi exceeded the speed limit on the Oxley Highway Port Macquarie. Ciardi was recorded as driving at 120km/h where the speed limit is 90km/h.
Ciardi was fined $450.
Affray
Alexander Coull 20, from McDonald Lane, Laurieton pleaded guilty to a charge of affray.
Facts said between 7.59pm and 8.10pm on December 21, 2016 Coull used unlawful violence towards a person. The incident took place at Laurieton where pushing and shoving ensued between all parties and a number of verbal allegations and threats were made.
In handing down the sentence the Magistrate told Coull the decisions you make can have a lasting impact on the rest of your life. Coull was directed to enter a bond under section 10 (1) (b) for a period of two years.
Licence expired
Louise Dianne Cramp 35, from Roslyn Street, Port Macquarie pleaded guilty to licence expired less than two years before (second offence).
Facts said about 1pm on April 14 Cramp drove a silver Subaru Forester south on Ocean Parade, Lake Cathie. She was stopped by police and unable to produce a driver's licence. Checks revealed Cramp's licence expired on January 24, 2017.
Cramp was fined $700 and is disqualified from holding or obtaining a licence for three years.
Drug driving
Jessica Frances Lawrance 27, from Hollingworth Street, Port Macquarie pleaded guilty to a charges of drive while an illicit drug was present in her blood, a charge of licence expired less than two years before (prior offence), drive vehicle with illicit drug present in blood (second offence) and licence expired less than two years before (prior offence).
Facts said between 2pm and 2.10pm on November 20, 2016 Lawrance drove a vehicle on Hollingworth Street under the influence of methylamphetamine. On the same date checks revealed Lawrance's licence had expired on October 10, 2016.
For the two charges of driving while an illicit drug was present in blood Lawrance was fined $200 on each matter and was disqualified from driving for six months. For the two charges of driving while licence expired Lawrance was fined $200 on each matter and was disqualified from holding or obtaining a licence for three years.
Stolen property
Andrew James Macdonald 37, from Charles Street, Wauchope pleaded guilty to drive while licence cancelled, use unregistered vehicle, use uninsured vehicle, negligent driving, resist arrest, steal property, steal vehicle and trespass.
Facts said between 2.55pm and 3pm on February 15, 2016 Macdonald drove on Weismantle Street, Wauchope while his licence was cancelled. The vehicle was not registered and was not insured. On the same date facts said Macdonald drove negligently by speeding and narrowly missing a letterbox when coming to a stop.
Facts said on December 19, 2015 Macdonald resisted arrest between 2pm at 2.10pm at Wauchope by hiding in a cupboard to conceal himself.
Facts said between 1pm and 3.50pm on November 13, 2015 Macdonald stole property of building material to the value of $5000 from a property at Herons Creek. On the same date he stole a 250cc trial motorcycle and trespassed onto a property at Herons Creek without consent of the owner.
For driving while his licence was cancelled Macdonald was fined $700 and was disqualified from driving for six months. For using an unregistered vehicle he was fined $500. For driving an uninsured vehicle he was fined $500. For negligent driving Macdonald was fined $450 and was disqualified from driving for three months. For resisting arrest he was fined $500. For the charges of stealing property and vehicle Macdonald was sentenced to imprisonment for 12 months which was suspended under a 12 month good behavior bond. For trespassing Macdonald was fined $300.
Ammunition possession
Chloe Lyn Martyn 34, from The Tiller, Port Macquarie did not appear on charges of drive vehicle with illicit drug present in blood (second offence), driver not wear seat belt properly and possess ammunition without holding licence or permit.
Facts said between 5.40pm and 5.45pm on February 1 Martyn drove on Hastings River Drive, Port Macquarie under the influence of delta-9-tetrahydrocannabinol. She was not wearing a seatbelt and police found a single .22 calibre round of ammunition in Martyn's purse.
For driving with an illicit drug present in her blood Martyn was fined $600 and was disqualified from driving for eight months. For the seat belt charge Martyn was fined $250 and for the ammunition charge Martyn was fined $300. The ammunition was ordered to be forfeited.
No licence
Aisling McNamara 35, from Ben Lexcen Drive, Robina pleaded guilty to driving without a licence.
Facts said at 4.45pm on April 15 McNamara drove south on Pacific Drive, Port Macquarie when she was stopped by police. Checks found McNamara had never obtained an Australian driver’s licence.
McNamara was fined $150.
Drink driving
Ute Susanne Morris 41, from Lyndale Avenue, Port Macquarie pleaded guilty to driving with a low range prescribed concentration of alcohol.
Facts said at 12.15am on April 16 Morris drove on Granite Street when she was was stopped by police for a mobile breath test. Morris returned a positive reading and she was conveyed to the Port Macquarie Police Station. A breath analysis test produced the reading of 0.069.
Morris was directed to enter a bond under section 10 (1) (b) for 12 months.
Fire charge
Conner Andrew Perkins 18, from Geraldton Drive, Newcastle pleaded guilty to a charge of intent to cause fire and be reckless to its spread and a charge of drive recklessly/furiously or speed/manner which is dangerous.
Facts said on October 3, 2016 between 1pm and 3.30pm Perkins intentionally caused a fire at Kendall and was reckless as to the spread of that fire to bush land on the edge of Batar Creek Road, Kendall.
On the same date facts said Perkins drove a motor vehicle in a manner which was dangerous to the public on Batar Creek Road, Kendall.
For the fire related charge Perkins was fined $1000 and sentenced to a good behaviour bond under section nine for two years. For the dangerous driving charge he was fined $800 and was disqualified from driving for 12 months.
No licence
Jaime Louise Sepping 29, from Oxley Highway, Ellenborough pleaded guilty to driving without a licence.
Facts said about 2.25pm on April 16 Sepping drove a vehicle west on Oxley Highway, Hartys Plain when she was stopped by police. Checks revealed Sepping did not have a licence.
Sepping was fined $700 and was disqualified from holding or obtaining a licence for three years.
Drug driving
Susan Jayne Smillie 34, from Oak Close, Lakewood pleaded guilty to two charges of posses prohibited drug (breach of bond) and driving with an illicit drug present in the blood.
Facts said between 2pm and 2.15pm on September 15, 2016 Smilie drove a vehicle on Macleay Valley Way, South Kempsey while there was methylamphetamine in her oral fluid.
Facts said between 4.45pm and 6.30pm on September 11, 2015 Smillie was found to have in her possession 3.7 grams of methylamphetamine at Laurieton. On the same date she was found to have 1.2 grams of cannabis in her possession.
The Magistrate took no action of the breach of bond charges. The section nine bond for two years still stands. For the charge of driving with an illicit drug present in the blood Smillie was fined $350 and was disqualified from driving for four months.
Breach of AVO
A man aged 44, from Wauchope appeared via audio video link and pleaded guilty to five charges of contravene a restriction or prohibition in an AVO.
On May 4 the man was arrested and charged for breaching the AVO in relation to incidents in April and an incident on May 2.
The Magistrate sentenced the man to a period of imprisonment of seven days from May 4 until May 10.
Drug driving
Glen Darren Walbank 45, from Oxley Highway, Ellenborough appeared via audio video link and pleaded guilty to a charge of driving while there was an illicit drug present in his blood, second offence.
Facts said between 1.15pm and 1.20pm on January 22 Walbank drove a Hyandai Excel on Oxley Highway, Port Macquarie while there was methylamphetamine and delta-9-tetrahydrocannabinol in his oral fluid.
Walbank was fined $800 and was disqualified from driving for 12 months.
